No lease for one year now I want to move. I paid first, last and security.?
When I moved in after a grueling background check last April, my nutcase landlords insisted this house was ‘mine.’ I do all the maintainance: yard, house repair, ceiling fan installation, plumbing…etc etc etc. Now that I want to move out because I’m too tired to keep up with the work on the almost 100 year old house in Florida they are saying I didn’t pay last months but a ‘big security.’ Whatever. I have cancelled checks but what are my legal rights if any with no lease and what are their legal rights if any with no lease? I have taken good care of the property and it is clean and not damaged but they are insisting I need to trim the palms before I move, remove the grass from the cracks of the sidewalk…get the leaky faucet and toilet fixed. I’m ready to fill wall hanging holes and spot paint and clean like a banshee but nothing more. Thoughts please smart folks????????
If you don’t have a lease, they can’t enforce the maintenance provisions against you. Fix the faucet and toilet, but I’d leave the palms and the sidewalk grass.
Your cancelled checks will help you, if one is marked “security deposit,” and the other says “first/last.” You will need some kind of itemization to show what is what, but regardless, they must give you a final statement within three weeks of your move-out, along with a refund check.
If you receive neither, or if you are charged for things you don’t feel you should have to pay, take them to small claims court.
